    Terms and Conditions

    The following Terms and Conditions constitute a legal agreement between Polite Health LLC (DBA: Polite Hemp) and you ("Partner/Affiliate"). By signing up to be an Affiliate in the Polite Affiliate Membership Program ("Program") you agree to be bound by the following Terms and Conditions. Please ensure that you read them carefully prior to signing up.

    Definitions:

    "Agreement" - the contents of the contract between Polite Hemp and the Partner in respect to the Program.

    "Program" - The Affiliate program as set out on the Site and is governed by this Agreement.

    "Partner/Affiliate" - Party who agrees to take part in the Program.

    "Link" - HTML link provided to the Partner to link the Affiliate’s social media channels to the Site.

    "Site" – www.staypolitehemp.com website.

    1. The Agreement

    1.1. A Partner must provide the full legal name, e-mail address, and any other information requested in order to create an Affiliate account.

    1.2. Polite reserves the right to update and change the Terms from time to time without notice.

    1.3. Any modifications or changes to the Program shall be subject to these Terms.

    1.4. Partner/Affiliates may not use the Program for any illegal or unauthorized purposes.

    Violation of these Terms and Conditions may result in the suspension of your right to be a Partner and may result in lost commissions and/or removal from the Program.

    2. Modification of Polite Affiliate Membership Program Terms and Conditions

    Polite Hemp reserves the right to modify or otherwise change the Terms and Conditions of the Agreement at any time. In the case of any modifications to the Terms and Conditions in this Agreement, the Partner will be notified by e-mail. If the Partner refuses to accept any modification, the Partner's only option is to terminate the Agreement. 

    3. Partner Account

    In order to join the Polite Hemp Partner network (powered by Refersion), the Partner must complete and submit the online application and create a login and password located at https://staypolitehemp.refersion.com/affiliate/registration . From this account, the Partner will be able to track and view sales and receive commission payments.

    4. Legitimate Methods of Advertising

    4.1. Partner is permitted to use links, discount codes, any related banners, or text advertisements provided by Polite Hemp through its Partner Program.

    4.2. Partner is not permitted to promote any non-Partner Program-related materials, such as coupon codes provided in Polite Hemp customer newsletters, codes provided to other Partners, any other promotional codes or coupon codes received from any source other than directly from the Polite Affiliate Membership Program.


    4.3. Any promotion must follow FDA and FTC rules and regulations governing legal hemp products.

    4.4. Any promotion should include the offer, discount code (if applicable), and link provided by the Polite Affiliate Membership Program.

    4.5. Partners must remove invalid codes and banners from their social media accounts once they become outdated or are no longer working.

    4.6. Partner coupon codes and links are not to be promoted on third-party websites such as coupon databases.

    4.7. Any sales that have been generated through improper promotion will result in loss of commission.

    4.8. Polite Hemp reserves the right to take legal action against any Partner that commits fraud or refuses to comply with the Terms and Conditions set forth in the Agreement.

    5. Copyrighted Material

    Partner is responsible for ensuring that product descriptions and images comply with all applicable copyright, trademark, data protection, any intellectual property rights or any other applicable law. Polite Hemp will not be responsible if a Partner uses another party's copyrighted material in violation of the law.

    6. Commissions & Payments

    6.1. Partners shall receive a commission for referring authorized sales via links provided by Polite Affiliate Membership Program to Polite’s website. The customer must make a purchase by clicking the link on the Partner's social media page within 30 days of the initial click-through.

    6.2. The commission is based on the net price (net of any discounts, taxes and shipping charges) of the product that is sold and approved once it has been 45 days from the purchase date. Payments are made once a Partner has generated a minimum of $50 worth of commissions.

     Wholesale and personal Affiliate orders do not qualify towards Affiliate commissions [md1]

    6.3. Commission rates may be changed at any time by Polite Hemp and current applicable commission rates may be viewed by logging into the Partner's account. [md 3] Partner will be made aware of commission changes, not including limited-time promotional commission changes. 

    6.4. Polite Hemp is not responsible for any lost revenue or incurred costs as a result of a Partner using an invalid link. It is the Partner's ongoing responsibility to determine whether a payout associated with any particular link provided has been discontinued by Polite. 

    6.5. The commission is paid only on links that can be tracked and reported by Polite Affiliate Membership Program systems powered by Refersion. In order for Reversion to properly track any referral, the customer must have their cookies enabled on their web browser. Polite is not responsible for any lost revenue or incurred costs as a result of customers not having their cookies enabled at the time they make a purchase. Partners will not earn commission on any orders purchased for themselves through these channels. Wholesale and personal Affiliate orders do not qualify towards Affiliate commissions[md4]

    6.6. Commissions are eligible for the duration of a "Subscription Order" if in the event the customer purchases with that option through the Affiliate’s trackable link as provided. However, if the customer has an existing subscription and decides to cancel it, then proceeds to sign up for another subscription after that, no commission shall be paid to the Partner. Commissions for subscriptions will continue to be based on the net price of the subscription order. [bp2]

    6.7. Refunded payments do not qualify for commission fees. To the extent a customer receives a refund, no commission shall be paid to the Partner. 

    7. Polite Obligations

    Polite Hemp agrees to undertake the following obligations:

    7.1. Providing the Partner with promotional materials, such as links, coupon codes, banners and any other graphic materials Polite, in its own discretion, believes necessary to properly promote its products.

    7.2. Processing all orders for Polite Hemp products sold via the Partner's links.

    7.3. Tracking sales generated via the Partner's links.

    7.4. Providing timely payment processing, cancellations, returns and other related customer service activities for Polite Hemp products sold via the Partner's links.

     8. The License

    8.1. Polite Hemp grants to the Partner a non-exclusive, non-transferable, revocable right to access the Polite Hemp site through certain links provided to the Partner by Polite Hemp via Reversion in accordance with the Terms and Conditions of this Agreement and in connection with any promotional materials provided and authorized by Polite Hemp .

    8.2. Partner cannot modify or change any materials provided by Polite Hemp in any way.

    8.3. Both parties agree not to use the other party's materials in any manner that could be construed or considered to be misleading, disparaging or otherwise portraying the other party in a negative light.

    8.4. Any inappropriate use of the promotional material may be cause for immediate termination of the Agreement. 

    9. Limitation of Liability; Indemnification

    Polite Hemp will not be liable to the Partner for defects in the service provided by Refersion, access interruptions to the service, loss of data via the information handling system or viruses, loss of profits, or any loss caused by any third party by deleting, removing, deactivating or tampering with the Partner tracking service or any other consequential loss, whether arising from neglect, error or breach of contract. Partner agrees to defend, indemnify and hold harmless Polite and its parent, affiliate and subsidiary companies, and their respective owners, officers, directors, employees, shareholders, agents, representatives, successors and assigns (the “Indemnified Parties”) from and against any and all claims brought or asserted against any of the Indemnified Parties by a third-party (including a governmental body) to the extent arising out of or relating to any Intellectual Property Claim or any content posted to any of Partner’s social media platforms or websites.  As used herein, the term “Intellectual Property Claim” means any third-party claim brought against any of the Indemnified Parties alleging that any intellectual property utilized by Partner infringes any valid patent, copyright, trade secret, trademark or other proprietary right of such third-party.

    10. Termination

    The Term of the Agreement shall commence upon Polite Hemp acceptance of the Partner's Polite Affiliate Membership Program application and can be terminated by either party. Affiliation can be ended with or without cause at any time, by one party providing the other party notice of termination in the form of e-mail. Upon termination of the Agreement, the Partner will remove all links to the Polite Hemp website, as well as any and all banners and/or graphic images provided to the Partner in connection with the Polite Affiliate Membership Program.


    Privacy Policy

    This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from terravitacbd.com (the “Site”). 

    PERSONAL INFORMATION WE COLLECT 

    When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.     Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. We refer to this information as “Order Information”. 

    When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. 

    HOW DO WE USE YOUR PERSONAL INFORMATION?

    We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: 

    - Communicate with you; 

    - Screen our orders for potential risk or fraud; and 

    - When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. 

    We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns). 

    SHARING YOUR PERSONAL INFORMATION 

    We share your Personal Information with third parties to help us use your Personal Information, as described above.     Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.     DATA RETENTION 

    When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. 

    CHANGES 

    We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. 

    MINORS 

    The Site is not intended for individuals under the age of 18.
